These Terms of Service ("Terms") govern your use of Safe9ja Gmail Campaigner ("the App"), a browser-based email campaign tool developed for safe9ja.com. By accessing or using the App you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Description of Service

Safe9ja Gmail Campaigner allows you to upload a list of email recipients (in CSV format), compose a personalized email message using merge tags, and send individual emails through your own Gmail account via the Google Gmail API. All processing occurs in your browser — no data is transmitted to or stored on our servers.

2. Eligibility

You must be at least 18 years old and have a valid Google account to use the App. By using the App you represent that you meet these requirements.

3. Acceptable Use

You agree to use the App only for lawful purposes and in compliance with all applicable laws. You must not:

  • Send spam, unsolicited commercial messages, or bulk email to recipients who have not consented to receive your messages.
  • Violate Google's Terms of Service or Google APIs Terms of Service.
  • Exceed Gmail's sending limits or use the App in a way that could result in your Google account being suspended.
  • Send messages containing malicious code, phishing content, or fraudulent material.
  • Impersonate any person or organization in your email campaigns.
  • Use the App to harass, threaten, or harm any individual or group.
  • Attempt to reverse-engineer, decompile, or tamper with any part of the App.

4. Email Sending Best Practices

You are solely responsible for ensuring that your use of the App complies with all applicable anti-spam and email marketing laws, including (but not limited to):

  • The CAN-SPAM Act (United States)
  • GDPR (European Union) — if you collect or process personal data of EU residents
  • CASL (Canada)
  • Any local laws in your jurisdiction

This includes, where required, providing a clear way for recipients to unsubscribe, honoring unsubscribe requests promptly, and maintaining verified opt-in lists.

5. Google Account Responsibility

The App sends emails using your own Gmail account. You are solely responsible for maintaining the security of your Google account and for all activities that occur through it. We are not responsible for any suspension, restriction, or termination of your Google account resulting from your use of the App.

6. Intellectual Property

The App's code and design are owned by the developer. Nothing in these Terms grants you any rights in our intellectual property other than the limited right to use the App as described herein.

You retain full ownership of all content you create, including email templates and recipient data. We claim no rights over your content.

7. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that the App will be error-free, uninterrupted, or free of security vulnerabilities. Email delivery depends on Google's infrastructure and recipient servers, which are outside our control.

8. Limitation of Liability

To the fullest extent permitted by law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App — including damages resulting from email delivery failures, Gmail API errors, Google account restrictions, or data loss.

9. Indemnification

You agree to indemnify and hold harmless the developer from any claims, damages, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

10. Termination

We reserve the right to discontinue or modify the App at any time without notice. You may stop using the App at any time. Sections 6, 7, 8, and 9 survive termination of these Terms.

11. Changes to These Terms

We may update these Terms at any time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be resolved in the competent courts of Nigeria.
